NFL star Joey Porter is officially off the hook for allegedly slapping a deputy's hand away during a traffic stop last week.

The Kern County District Attorney's Office tells TMZ there was not enough evidence to move forward with the case -- in which Joey was facing three misdemeanors: DUI, resisting arrest and assault on a peace officer.

Joey was arrested in Bakersfield, CA on Friday, after an alleged confrontation with a California Highway Patrol deputy during a traffic stop in a Taco Bell parking lot.

As we first reported, the CHP launched an Internal Affairs investigation into the deputy that arrested Joey, after the Arizona Cardinals player claimed he was manhandled during the arrest.

Operating room spies tell TMZ Thiago Alves just underwent an 8 hour operation to separate an artery from a vein in his brain.

Dana White tells TMZ the operation -- in a New York City hospital -- was a complete success and Pitbull's first words ... "When can I start training again?"

Dana's answer ... a couple of weeks.

We're told Pitbull will be in ICU for the next two days.

TMZ has learned Machine -- which is the fighter's legal name -- was arrested outside a bar called Thruster's Lounge around 11 pm.

Law enforcement sources tell us Machine and another male were fighting with bouncers -- and when cops tried to approach the situation, War Machine took off running.

Eventually, cops caught up with the 28-year-old, threw him in handcuffs, and for some reason, put a spit bag over his head ... which is generally applied when the perp gets a little too aggressive with his oral fluids.

Machine was arrested for assault with a deadly weapon -- though it's unclear what the weapon is. He's currently being held in a SD jail.

There have been multiple reports that the Oakland Raiders are the front-runners to acquire the Pro Bowl QB through a blockbuster trade -- but a source close to McNabb tells TMZ, "He does NOT want to play for the Raiders and would refuse the trade."

McNabb reportedly does not have a no-trade clause in his contract -- but according to Philly.com, he can refuse to negotiate a contract extension ... and most teams wouldn't trade away draft picks or players to get Donovan for the one measly year he has remaining on his current contract.

Pittsburgh Steelers wide receiver Santonio Holmes told cops that his accuser called him a "f*ck n*gger" on the night he was accused of attacking a woman with a glass, this according to the police report.

According to the documents obtained by TMZ, an off-duty officer who was working at Club Rain in Orlando on March 7 -- the night of the alleged incident -- claims he spoke with both Holmes and his accuser, Anshonae Mills, outside the club ... and got two completely conflicting stories.

The officer claims Holmes told him that he tried to walk away from a conflict involving a seat in the VIP section when Mills grabbed him by the wrist and called him a "f*ck n*gger."

Holmes then said that an unknown woman in the club threw the glass that eventually struck Mills in the face.

The deputy who arrested NFL star Joey Porter is under investigation for alleged brutality ... law enforcement sources tell TMZ.

As we previously reported, the Arizona Cardinals linebacker was busted during a traffic stop at a Taco Bell in Bakersfield, CA over the weekend.

Porter was busted for allegedly slapping the deputy's hand away as the deputy tried to unlock Joey's car door. Joey claims the deputy manhandled him, striking him in the face.

Now we've learned CHP has launched an Internal Affairs investigation into the deputy's conduct.

UPDATE: TMZ spoke with Porter's agent, Jeff Sperbeck, who tells us, "It's unfortunate that Joey has to endure the negative fallout surrounding this investigation."

Sperbeck added, "Joey has always been respectful and supportive of law enforcement in Bakersfield; the fact that one officer acted inappropriately will not change his views. We are confident that Joey will be exonerated from any wrong doing after all the facts have been reviewed."

The Hooters in Augusta -- literally seconds from where Tiger will be smacking his balls around -- will throw a week-long, golf-themed celebration ... which includes competitions custom-made for Woods.

Among the activities -- a putting competition and a long drive contest ... a "Par 3" bikini contest.

Sounds great but we're guessing if Tiger's in the mood for chicken wings, he better pray they're on the room service menu.

Jayson was just transferred to his permanent home at the Mid-State Correctional Facility in Wrightstown, New Jersey where he flashed his pearly whites for his new intake photo.

We're told Jayson -- who's serving time for the 2002 shooting death of his limo driver -- will be placed in the general population. But there's good news. The prison takes part in the Jersey Fresh program, so he'll get locally grown fruits and veggies all the time.

Jamie's lawyers requested the astronomical amount in part because they say she has to pay mortgages on seven houses.

Outside of court today, Frank's lawyers came out swinging by claiming Jamie uses one house to do laundry, one to hold her furniture and one as a $27 million swimming hole ... and if she wants to pay the mortgages, she can simply place some of the multi-million dollar mansions up for rent.

Frank and his legal team were leaving court today in L.A., where Frank's bitter battle with Jamie over spousal support continues.

Frank's lawyer said Jamie would have been allowed inside Dodgers Stadium yesterday to clean out her office ... if she wouldn't have made such a spectacle out of it.

He's gorgeous, talented, stylish, rich, in love and helpful? Unreal.

... and she's not too bad either.
